Whose fault?

Postby kp1512 on Sat Sep 03, 2011 5:56 pm

So had a little knock on a main roundabout and a little confused as to any recourse...

Situ

I was on the roundabout - attemtping to leave my exit - another car from the adjoining lanes [that are about to join the roundabout] overshoots the give way line and blocks my lane so I have to stop! I emergency brake and the 3 Lanes that are joining the roundabout - 2 lanes stop and one car in the 3rd land doesnt look ahead - and is too busy looking to the right to join.....so after I am stationary - about 6-8 secs later - BANG she smacks my rear passenger side.

Now the car in front that I had to emergency brake for look at me at this i raise my arms as WTF? and she speeds of?

Have i any comeback to them?

I was told that whilst she caused it - it was a hazard and not her fault but I find this hard to beleive?

The lady that hit me was a nigerian - but thankfully insured!!!

I am hoping she will be honest mate

I got out and ask her to pull in to the comet Car park and said what happened? and she said "she didnt see me" but obv she can say she never said that.

The fact that its my rear passenger side and her front - means surely that it cant be my fault? I took pics as well.

Lets see this week -if she lies

I had her insurance call me asking if I had whiplash and almost encouraging me to claim for some reason?! makes me sick when ppl make this stupid claims!

i am sure you will be fine, i think on the whole nigerians are very generous, i get a lot of emails from them taking pity on me and wanting to deposit vast sums of money if i give them my bank account details.

The car that overshot the give way is at fault but if you dont have the reg there is little you can do .
You were in the carriage way before that car entered .

In any case the driver who went up your arse will have to pay for your damage etc

cheers

well gota say - AXA have been pretty much amazing....get this for service

- Accident happened last Thursday at 4pm
- got home and logged a claim on the online portal at 5pm
- got a call from AXA at 530 - asking for details and what happened
- got a call from the repair garage at 6pm on the same day and car booked in this week - they wanted it the next day
- Friday got a call from the Claims Handler just confirming all ok and asked for a diagram usign a website where you draw what happened
- Yday got another call saying my NCB back on account as other party admitted total liability
- This morning claim closed!?!? from my perspective and I wont hear from them again on the claim as theyll chase all the money due

Can anyone beat that?

Often we all get crap service - but this was almost top of the game!!

Im gobsmacked!
